It's not just living deceased are included. Pension act dates back to WWII so really if someone was alive till 2004 from that war and was receiving those benefits then they're family would be entitled.
Yes on closer inspection, it does seem like it will exclude anyone pensions after 2006.

Bummer.
 
Ok so the site to put in a claim shows exactly what benefits are entitled. This should put a rest to it.

The governemnt terms everything ‘pension for life’ as a suite of benefits including pain and suffering. This is just another sh1tshow rollout from an incompetent government.

Pension for life is NOT the pension act.
 
It’s derived from the New Veteran’s Charter which is an amendment to the Pension Act.
Ok maybe this will make more sense. Since it's been "amended" those vets that fall under the new amendments like pension for life do not apply to this lawsuit.

At the end of the day you can argue whatever you want but unless you were collecting the benefits shown in the photo you won't be recieving anything.

(In summary, I think it includes EVERYONE who is receiving any payment from VAC)

All members and former members of the Canadian Armed Forces and Royal Canadian Mounted Police, and their spouses, common law partners, dependants, survivors, orphans, and any other individuals, including eligible estates of all such persons, who received – at any time between 2002 and the present – disability pensions, disability awards, and other benefits from Veterans Affairs Canada that were affected by the annual adjustment of the basic pension under section 75 of the Pension Act including, but not limited to, the awards and benefits listed at Schedule “A” of the certification order:

  • Pension Act: pension for disability; pension for death; attendance allowance; allowance for wear and tear of clothing or for specially made apparel; and exceptional incapacity allowance;
  • Veterans Well-being Act: disability award; and clothing allowance;
  • Veterans Well-being Regulations: remuneration of an escort;
  • Veterans Health Care Regulations: remuneration of an escort; and treatment allowance;
  • Veterans Review and Appeal Board Act: compassionate award;
  • Civilian War-related Benefits Act: war pensions and allowances for salt water fishers, overseas headquarters staff, and air raid precautions workers; and injury for remedial treatment of various persons and voluntary aid detachment (World War II);
  • Children of Deceased Veterans Education Assistance Act: monthly allowance for education; and
  • Flying Accidents Compensation Regulations: flying accidents compensation.
 
Also, to add more fuel to this fire, my friend had his VAC Case Manager answer this as well and he SPECIFICALLY asked her does this include any of us who RECEIVED DISABILITY AWARDS LIKE LUMP SUMS and she said absolutely yes, even Disability Awards benefits such as Lump Sums or ANY VAC payment of any sort so there you go and then she told him to submit his claim online. This is his Case Manager who knows her stuff and is not one of those dimwit dumb ones who don't know anything. This is from a reputable source.
 
I just called straight to the horses mouth, the Manuge Class Action website Contact number and YES, I repeat YES, us Members who received any Disability Awards or Lump Sums WILL BE receiving Compensation from the Manuge Class Action! Wooooo! I even double repeated my question to her on the phone and it is 100% correct. Payouts won't be anytime soon thought so don't go skipping all the way to the bank. We will receive Payments by End of 2024. I am now relieved this confusion has now been put to rest. Enjoy your cheques my fellow Lump Sum Award folks!

You are correct that it says that but if you read the photo I posted it specifically states that disability award was included in the consolidated claim and certification order. It was removed in the final settlement document.

I believe they never bothered to update the website to reflect the final settlement document which would explain the issues as many just reading the site including those on the phone.

Paragraph 31 on page 10 of this document does seem to outline the changes regarding disability award recipients as you mentioned above

No. There was a subset of people who already received compensation. This particular action argued that there were MORE calculation errors….end of para 2, and para 3.
 
Well, it was pretty plain and clear what the Class Action folks told me on the phone. So either she has dementia/mind lost or she is correct and I triple checked asking her several times just to specifically make clear. She even read out the policy and it included Disability Awards INCLUDING anyone who received ANY FORM OF VAC BENEFITS SUCH AS LUMP SUM Awards. Then she told me to make sure I submit the online claim and that I will receive my compensation by End of 2024. No date, just a timeframe. She said ALL payments will be Finalized by end of 2024. So, I am going with what the Class Action folks are telling me.
 
Correct. That was the number I called.
I would be careful with how much faith you put into the info coming out of that number. I called last week, I may have spoke to spoke to a different lady than you but the one I spoke with just kept reciting what was on the webpage and couldn't answer very much.

What she did answer, contrary to what you were told, was that anyone who received any form of VAC benefits did not have to submit a claim.
 
I honestly ask that people read the final settlement document. In it it even states each benefit that is affected by this lawsuit. Whatever the website says and previous documents say is basically null and void unless it is this document as it is the document that lists the specific benefits to be compensated. Lump sums are not on the list.

If you still believe you will receive something I would expect for your hopes to be dashed come the end of 2024.
