Wherever boundaries are set on the exercise of power, there will need to be somebody (or some body) that decides whether an exercise of power has exceeded that boundary, such that it is invalid: "ultra vires", being the legal term - beyond one's authority. Canada was different from the UK right...

Probably, in some cases.  But in others, it's a "free" choice governed by adherence to a religion.  Just as "free" as the choice to go to confession for Catholics.
