Now Im no lawyer here, but is a federal judge’s power to rule an EO unconstitutional is now jurisdictional? Does that basically mean different “interpretations” of the constitution apply nationwide?

That’s not much of a constitution in my eyes if it can now be bent that easily…

The fourth estate lost all credibility years ago when it comes to politics. And yes, I did quite enjoy that. I also quite enjoyed the briefing that followed including the patriotism reflected and shout outs to the crews involved and development over many years of that specific target.

So, the courts have’’t yet ruled on the constitutional merits. Today’s ruling is only on how sweeping the interim injunctions are. Essentially it means that rather than one big ‘applies everywhere’ injunction, lower courts will have to hear narrower legal actions and rule on them individually in terms of injunctions. The overall constitutionality of the attempt to end birthright citizenship will still have to proceed through court for a decision on the merits. The fear of course is that while that’s still going, someone could have their citizenship stripped and face deportation.

As long as the SCOTUS knows they have opened the door to millions of people filing individual suits, clogging up the lower courts as they seek to get those narrower injunctions.
