Topical to this: farther upthread I and others have mentioned that the conditions of provincial corrections are a constraint to holding more people in custody and are a factor in more people getting bail.
A judge has just stayed proceedings (stopped the prosecution) against three charged with murder due to “torturous state actions” at Ontario’s Maplehurst Correctional Complex. This arises out of events in December 2023 where inmates were collectively abused following an assault on a guard.
Conditions in provincial corrections are pretty dire, and this absolutely needs to be addressed ASAP if we want to see more ‘jail not bail’.

Nothing heard but I haven’t really looked for it.
So once again, accused rights trump victim's rights. Two days sitting in your underpants plus zip ties on your wrists equals a get out of jail free card for murder (alleged). Not bad. I surely hope there was more to the guards' actions than just that. There had to have been a better solution by the judge.

I’m still waiting to read the judge’s written decision- and I’m sure there will be an appeal. But the main thrust of this is that the state’s conduct was so utterly egregious that the court had to disassociate itself from it. Judges do not use words like ‘torturous’ lightly. Presumably if that case was tossed, many others have been or will be.
Do I think this is an extreme response? Yes. Do I like it? No. Am I ok with it? Also no. Do I recognize and understand why the judge felt pushed to this point? Yes. Do I recognize that this is a HUGE “oh shit!” signal that should be recognized for what it is, highlighting a part of our criminal justice system that has been broken and failing for years and risks the rest of it? Yes I do.

Where does the misconduct get addressed otherwise? Are you saying that accused (not convicted) individuals in custody can be abused without sanction? Are you saying that they should have defended themselves against their assailants?
Absolutely not what I am implying. It was in the form of a question? Wasn't there another solution that didn't involve turning a potential repeat murderer back on the street to take someone else's life.
Further to last week’s brief discussion on court cases being thrown out due to ‘torturous behavior’ at Ontario’s Maplehurst jail, here’s more detail. The judge tossed things not just because of the behaviour of guards but also because of what appears to be a concerted effort to over things up.
Mods, my apologies- this is a tangent that’s running off and parallel to federal government justice discussions. I don’t know if maybe we need a split thread to address bail, crime, etc?

This is what happens when you treat managers so badly for decades that no intelligent person with their head on straight would take the job.
And I do feel sorry for the CO's, after years of being assaulted, mocked, and laughed at, there probably was some over enthusiasm. You can only take having piss/shit/fists thrown at you for so long, with no punitive measures taken, before you relish a little payback.
But, ABSOLUTELY fuckin' ridiculous that this has anything to do with charges against people. Just more fodder to stop letting only lawyers be judges, corrupt as the mafia.........not even sure why we have elected officials/ rule of law anymore.

And PLEASE, lets stop whining about how bad it is in jail, most working folk would consider 6 months there a friggin' holiday. The worst thing you can do in jail?? Tell folks that it's not bad in jail......last time I remember a lad giving an interview for the local newspaper he had to go to protective custody, made the mistake of telling the truth.

Alternatively how about we keep the charges on the potential murderers and instead charge the criminal jail guards instead? If the jail guards are failing to follow the law that isn’t the justice systems fault, that is the guards. Root out the bad ones and put the legal boots to them.
My first reaction when I saw the photo in the article was, that’s one of Trumps prisons in El Salvador. Nearly 200 inmates were strip searched for a weapon which was a fist
. It’s unfortunate that this article and others only mentions that the superintendent was fired, not any mention of disciplinary action against the staff.Who said the managers were treated badly and by whom?

Corrections is a thankless job. I did provincial and federal. Canada lacks the prison infrastructure it needs and lacks the political desire to address it beyond blaming the CO’s and letting prisoners out.

We’re definitely going to need more jails if bail is going to be harder to obtain. Hopefully this is addressed in the budget.

I believe my brother in law was some sort of manager. lol.
The only people that treated him worse than inmates were all the other managers who wanted his job.
