It was my understanding that you could apply for an "Intent for an appeal", when it reaches the appeal board they decide if you could appeal the decision (whatever it is). My question is, Does the crown pay for the appeal? or is it out of your own pocket?

If you're referring to an appeal of a VRAB decision (which is carried out in Federal Court), then it's my understanding that the Crown now pays for the appeal.  Whether that means the services of a BPA lawyer are provided, or you're reimbursed for costs for a lawyer off the street, I'm not sure - but a call to BPA would probably get you the info you need.

Mods, this should probably be moved to the "VAC and other Soldiers' Benefits" board.

Sorry for the confusion, I meant to say appeal thru the military justice system.

Looks like it's covered if you have a military defense lawyer. If you hired a civilian one, it's out of your pocket for his/her fees.
