Being charged under military law?

He was not on duty and it did not happen on DND turf but was later "charged" by the CF for a variety of different breaches he made. He was released, and not on good terms. He spent over 2 years in a Fed jail, 3 years on probation and is now an electrician in Alberta.

If he was in the Regular Force when the offence was committed, he was "on duty" as far as being subject to the Code of Service Discipline goes, so laying other charges against him under the NDA was fair game (and, given the nature of his offence, probably a good idea IMHO...) Unlike our brethren in the Reserve, we RegF types are subject 24/7, on "DND turf" or not, in uniform or out. And, BTW,if he only did two years for attempted murder, he is pretty lucky.

Sorry, I meant he was not in uniform. It was a Saturday night. I am glad he got nailed both ways. He had given off to many "warning" signs that he was getting worse and worse in his behaviour, but nobody would do anything. I even called the MP's one night because he left my house drunk and high and was driving home. The MP's sat on the inside of the main gate to the barracks, stopped him and asked how his night was and then let him proceed onto the base to go back to the shacks. He should have been charged with a DUI at least!!

I agree with you that he was very lucky in getting such a short sentence...he should have been in there ALOT longer.
