Do you need a medical diagnosis for pain and suffering compensation application?

Hello,

In 2016 I sustained a shoulder injury on deployment, been hurting ever since. I did the odd physio and limitation of movement is obviously there, however, I have never officially gotten a medical diagnostic. When filling out the PSC application on the VAC website, it asks if there was a medical diagnosis, I clicked "no" and I can continue to fill out the form.

My questions are, will VAC consider my claim even if I don't have a diagnosis? Will they have me see one of their doctors? Is it better for me to go to sick parade to try and get a diagnosis before applying to VAC?

Why would you live in pain without getting it diagnosed? Maybe the docs can fix it?
 
I know that's the CAF default but if you go back and be assertive they'll actually start doing tests. For some reason its like the money for imaging and specialists is their personal money. VAC isn't going to pay you out for an unknown issue, even people with chronic pain have to have a doctor diagnose it as chronic pain.

My experience is they send people to physio because they don't know what it is, and physio isn't allowed to diagnose but can't do much without a diagnosis. Our sports medicine injury handling is atrocious.

Is the original injury documented? CF-98? VAC is very used to dealing with long term injuries where troops just ‘sucked it up’ for years. But you will want to get a proper assessment done.

Yeah I have a cf98 and two witness statements. Can I get a medical assessment after already submitting the application? Would they care if the assessment was done after the application?

Get the application in ASAP. Your claim gets backdated to the date of application.

The best referral I can offer with VAC claims is to reach out to the veterans Service Officers at the Royal Canadian Legion. They’re full time paid staff whose job it is to assist with claims. They excel at it. There’s no cost, no fee, no percentage taken. It’s a service the Legion provides out of its budget, and you don’t have to be a legion member. They can fully represent you.
