Freedom Convoy protests [Split from All things 2019-nCoV]

Youre surprised to find out shes an entitled person with little respect for the rule of law and no understanding of consequences ?

I always thought she gave off serious Karen vibes…

The Supreme Court of Canada has granted the government leave to appeal the Federal Court of Appeal decision that, in turn, upheld the Federal Court decision ruling the invocation of the Emergencies Act unjustified. Leave to appeal simply means the court will hear the appeal and really only indicated that SCC thinks it's a matter of enough national significance to merit their time and attention, or to rule with finality on a particular point of law.

Based on the FC and FCA decisions I would be surprised if the FC decision were overturned at SCC. The link of a Public Order Emergency to the CSIS Act definition of a 'threat to the safety of Canada' is pretty clear cut, and FC was quite unconvinced of that, although a deferral to the contemporaneous judgment of Cabinet is not out of the question. There might also be arguments on whether this was in fact beyond the capacity or authority (as opposed to 'willingness') of a province to deal with it, and that could not be dealt with under any other (federal) law of Canada. Anyway, whenever this does finally get heard it'll be interesting.

Is there any plans to have an iquiry into the failure of government(s) in allowing a convoy to occupy parliament hill, when they had at least a week to prepare for their arrival?

Or did I miss it?

The Public Order Emergency Commission looked at a lot of that. Point to note- they mostly occupied downtown municipal streets, and travelled provincial highways to get there. The Feds have no independent authority to police Highway 17 or downtown Ottawa. Nearly all of this fell within the provincial constitutional authority over policing and administration of justice.

I would like to see the report from the commission.
I consider the occupation a massive failure of intel, coordination, and planning. But that is just me.

Got it

Friendly reminder from

"Supreme Court of Canada
Parties who disagree with the appeal court’s decision can appeal to the Supreme Court of Canada – but they first have to ask the Court to hear the case (except in very limited circumstances for some criminal cases).

The Supreme Court of Canada is the final court of appeal. It only agrees to hear cases that are important across the country or that have to do with unsettled areas of law. If it does not agree to hear a case, the decision of the court of appeal stands. If the Supreme Court agrees to hear a case, it can: reverse or change the judge’s decision, order that there should be a new trial or hearing, or agree with the court of appeal’s decision."
