COOKEVILLE, Tenn. - It's not what Santa intended.

A man in Cookeville, Tennessee, is thinking about suing Wal-Mart because the MP3 video player he gave to his little girl for Christmas turned out to be loaded with explicit tunes and porn videos.

Daryl Hill says the 10-year-old child burst into tears when she saw it. He says he just wishes he could get those "thoughts and images" out of her head.

Hill figures the player must have been returned by somebody who had loaded it with sex clips and songs about drugs.

Wal-Mart says it's investigating because returned items that have been opened are not supposed to be resold.

In the meantime it's offering Hill a replacement. But he says he's going to hang on to it until he talks to a lawyer.

Parents have control over that though.

They do not have control over something which is sold as "new and unused" (as per Walmart corporate policy prohibiting opened and returned items from being resold), only to discover it's not.

Someone screwed up here ... and it wasn't the family.

I suspect it's with thoughts of that in mind that the parents are retaining the MP3 player until they see a lawyer.  ;)

Do I think they should get millions of dollars? No, but perhaps this may cause Walmart to rethink fraudulently placing used and returned items back onto it's shelves and selling them to people like you and I as new & unused. It may also cause some other business' to do the same rethinking of the smartness of such a move.

Like the other Christmas present story along the same vein involving JC Penney...

Anyone wish to buy a brand new set of kitchen cannisters for their child as a gift only to have their child open said gift to find a "Partially used cannister" bearing a crematorium label (verified valid) on the bottom of said cannister?

Perhaps this family suing the ass off of Walmart (one of the largest retailers out there) for this gaff will actually cause those stores to sell these items as "used" ... and to inspect them upon their return, and I've got no heartache with that.

I bought a used iPod from Futureshop last year. Well one of those returned ones. And it had pictures of somebody's pussy cat on it. I still can't get the photos off it.  ;)

Doesn't sync it mean to exchange all my computer photos onto the iPod? I remember hitting such a button once on another MP3 I had... and it did that. So I'm not sure. Have you done it before?
 
I have a 30gig iPod video from last year.

There are options in iTunes. When you brows your iPod you can de-select certain things to upload. It's usually under the heading of pictures. You don't have to put any pictures on it at all if you don't want to.

If that doesn't work, reformat your iPod in iTunes then sync it to your iTunes library. I'm thinking that you are already using iTunes to put your music into your MP3 player.

In there you can make up your own play lists in the order that you want with the album art that you want as well.

It's answered all my questions and a whole lot more. The site is full of options for you to try, including hacks if you're into that stuff.

Play around in iTunes and experiment. The worst that could happen is that you have to do a reformat and sync again.

There are many other programs other than iTunes out there to sync your iPod and download music. I haven't tried them.....yet.
