I think you're cranky. I was relating an interview with an International Law expert I heard on the CBC a month or so, specifically on the topic of the implications of handing over a prisoner to another force.  I am making no claims in this thread.

I have some significant claims to make in regards to illegal interrogations, but my postings, and the responses were deleted 30 minutes after posting them earlier today.  I was told in a private message by a moderator that they knew I was a CBC employee, which is bullcrap. 

If you want me to make some claims, I will, but only if you promise not to delete the entire message and thread.

I think the part he was referring to was before their status under the convention was determined by a competent tribunal, and thus they need to be afforded the protection of it until such time. After that though, you are exactly right.

Remember, two elements of a crime.

EVEN IF, these prisoners were being tortured, if the officer handing them over had reasonable grounds to assume they would be treated properly, ie an international agreement between two governments that goes WAY above his paygrade to question, then he cannot be accused of having a guilty mind, even in terms of negligence.

The "reasonable man" test also applies. What would a "reasonable man" do if his government has a signed agreement with the other government, he is being ordered to carry out the transfer and has been reassured they will be treated properly by said agreement, and has no reasonable grounds to suspect anything otherwise?
