Sexual Assault & Sexual Misconduct in the CF

Yes, more to be done. Realistically speaking though, there is no way we're going to arrive at the100% solution, and that does not need to be taken as a negative. It also does not mean that we don't have to try.
The system it self will only give us an 80% solution, it is up to CAF members to fill in the other 20%, and its that human factor as to why it will never be 100%

Pushed right from 2020 when Military Judges fought to deny that they're military.

Not exactly a speedy trial is it??

This is one of 3 or 4 cases that were stayed back in 2020. The result of Jon Vance's 2019 order to move the military judges directly under the VCDS. Vance's order came about from the 2018 case of former chief military judge colonel Mario Dutil. Rory Fowler has some interesting commentary in his Blog. Also, if you search this site there is some discussion around the subject

A stayed charge is not one of guilt or innocence and can be continued at a later date. I'm sure there are lawyers on this site that can better explain this.

The 2024 SCC 15 Edwards decision.

SCC ruled late April 2024 and we’re now December 2025 to start the trial. I wonder if there’s been a Jordan application litigated on this one? I’m not sure how courts martial fall on the 18 vs 30 month provincial/superior court scale for Jordan purposes, also bearing in mind whatever time already ran on the clock before the applications that went to SCC. Though the Courts Martial website shows last week was booked for some sort of pre-trial applications. So something was presumably heard and decided.

Long time to have your life on hold with this kind of charge hanging over you.

That's a misstatement of what happened.

The order removed CMJ from being under the disciplinary authority of CFSU O-G, and restricted disciplinary authority to the VCDS for CAF members who are military judges - protecting them from interference by curtailing those who could charge them.

Unfortunately, military judges appear to have forgotten that they are military.
