Let's try this again, shall we?
This is a significant thing. CAF defence counsel services will represent a CAF member investigated for or charged with a service offence. A civilian lawyer for a simple criminal trial, probably upwards of $30k.To say nothing of the cost of a criminal defense for an accused individual; for a court martial, a military lawyer is provided; charged civvy side, and the lawyer bills in 12 minutes increments.
Reading the article it sounds like he’s simply NES? He’s been living in the U.S. for his civilian job for several years now. I don’t know what his trade is or if he’s jumped through the hoops to parade with an American reserve unit. But if you live outside Canada for four years it’s gonna be tough to stay in. Maybe there’s something we’re missing here. Unfortunately we cannot post the article to pick it apart. I’ll say that I would need to know what actual viable and necessary function he’s been proposing to fill remotely on a part time basis, before I can get outraged about his release. It sounds like Navy LT Patrick White who blew the whistle on alleged serial sexual offender "Officer X" is being kicked out of the military.
Another win for culture change.
100% the article is misrepresenting what NES is. It even states that the military is deeming the member to be "non effective". If the article was written by someone who doesn't know much about the military, I'd give them a pass for their ignorance, but in this case, it's a blatant effort to make a controversy over nothing. The navy was ready to actually declare them NES and remove them years ago, but delayed because of the whole Whistleblower thing. Now that that's done, they are doing their due diligence and following the appropriate administrative rules.Reading the article it sounds like he’s simply NES? I was thinking on that. It looks like he was trying to find solutions to remain in and still serving but the RCN shut him down. As you say, hard to pick apart.I don’t know what his trade is or if he’s jumped through the hoops to parade with an American reserve unit.

Looks like "Officer X" is still serving.
I suspect it's because if the RCN allowed him to make a random job in San Fran for himself, so he could stay in, they'd have to allow others to do the same.I was thinking on that. It was uncovered during the investigation that the navy was eager to kick white out for being a tattle tale. Still it's entirely possible the whistle blowing has nothing to do with him being punted.I suspect it's because if the RCN allowed him to make a random job in San Fran for himself, so he could stay in, they'd have to allow others to do the same.
Reserve Force Foreign Service requires the concurrence of both the sending and receiving states. If the RCN says" no" he's dead in the water. There is the option to work with allied reserve forces with the interchange program. I’ve known a few to do that.
It also creates a lot of administration to deal with those that do go this route. But it still has a time limit and extensions can be denied.
It also depends on what his situation is and if there is a prospect of returning.
We have a supp reserve for a reason though.

I'm curious what options he presented that were shot down. Especially when the navy reserve is begging for people due to recruiting shortfalls and retention issues. We also have lots of people working from home or on PT only chits for years.
At the end of the day it's hard to prove the career mangler is posting you because you pissed off the CWO mafia.
