There are multiple facets to the case. That’s just one. Thus far it sounds like the administration is getting some serious skepticism from at least a couple conservative judges.

If they defer to the president on what constitutes an emergency, the administration just switches to section 122, section 232, and section 338 tariffs and nothing changes.

Yeah maybe. But it’s appropriate for the courts to generally defer to the executive on what constitutes an emergency.
