When I first started we had at least one in on a "Lt Governors' Warrant" IIRC. He could be detained indefinitely.
As I think mine was since it was before the changes to the law in '91 or '92. I vaguely recall that there was still a review process but it was less formal and, I think, all institutional medical staff. Really old memory and it might have varied by province or even judge but I recall he was committed to 'the pleasure of the Lt. Gov.'

It's now a more formalized process. A friend of ours was appointed to the Ontario Review Board for a number of years and said there are always people who will never be back into society. How the 'Manitoba bus guy' got back into society surprises me but what do I know.

My Opinion Only - so its sketchy but the pysch docs all rallied around this guy as an example of how they can successfully treat severe mental illnesses so that the ill can reintegrate into mainstream society. The advocates for the mentally ill admonished us "peasants" that he was to be pitied and not vilified.

Yet we have a shit ton of inmates who are mentally ill and they don't get the attention or treatment.
 
Have to be a bit pedantic - insanity is not a clinical diagnosis, it's a legal term that' been replaced by "NCR By Way Of Mental Illness or Incapacity" or words to that effect. The disease patterns or personality traits they're exhibiting are diagnoses under the DSM whatever we're up to now - V TR I think. BTW, one diagnostic code I've yet to find - normal, well adjusted human. Food for thought.

Or that could also be a catch all s129 thing - my preceptor in psychiatry used to shake his head at me sometimes when he asked me what the multiaxial and then DSM IV-TR diagnosis was for someone and I'd say "They're F.I.T.H. - Fucked In The Head - because they've got traits from pretty much everything in that book"..."no Dx or Condition" could also mean "Je n'ais pas de clue qu'est - ce que phuque c'est ca?"

The DSM - Diagnostic and Statistical Manual is the textbook for defining diagnoses in psychiatry - lists all the traits/nuances of the various potential diagnoses and where people fit on the mental health spectrum. They each have a code as well for purposes of statistics and as short hand when transferring information in the clear. In days of old when Blackadder1916, myself, ModlrMike, mikeninercharlie, and others used to have to hand bomb admission and discharge messages, the diagnostics codes from he DSM and ICD (international Classification of Diseases) manuals to were used so that only those with the books knew why the person was admitted and again, to shorten the message length.
 
The accused will be assessed to determine if he’s mentally fit to stand trial.


Note that a trial fitness assessment doesn’t determine mental state at the time of the offence or if he was criminally responsible. A fitness assessment is to determine if he’s mentally competent to understand and participate in the proceedings against him and to instruct counsel and receive and understand advice. If he’s found unfit, generally he would be committed to treatment until such time as he’s in a mental state that allows his judicial process to go forward.

I’m familiar on a lay basis with both DSM 5 (and prior IV-TR) and the ICD. Just stuff I picked up along the way.
