Bringing 'Em Back or Not? (I.D.'ed Cdn ISIS fighters, families, kids?)

Some good news: another one of our ISIS returnees, Jamal Borhot, has been convicted of terrorism offences.


I need to wait for the written decision on this one but I’d been given to understand there was also some national security evidence disclosure law being contested on this one, and the pending decision on this may be of some significance to other cases. If in fact this verdict is part of that, even better.

Wonder how many Canadian "guests" are headed to IRQ now?

If I understand correctly, that makes any Canadian ISIS fighters now "guests" of Iraq, not the Kurds. If so, it'll be interesting to see how keen IRQ'll be about prosecuting them, versus "encouraging" other countries to take 'em back & prosecute them themselves. 🍿

PS - Harder to use the “they’re held by a group we don’t have official diplomatic relations with” soon ;)

Loadsa ISIS folk held by SYR Kurds now in IRQ custody. No numbers or confirmation that there are any Canadians among them, but I'd bet more than zero.

CAN recognizes IRQ as a country and all that, with diplomatic relations going along with it.

Some folks seem ... at least underwhelmed over how IRQ handles terrorism cases.

So, is Ottawa ready ready to deal with these guys? Any lessons learned from the Khadr case re: how to deal with Canadian nationals in the clink elsewhere for terrorism when we have our own laws to try them?

We'll see ...

Yeah, prosecutions back home could be challenging as hell from an admissible evidence standpoint. And some of them probably went over before the “travel to participate” offence was even created, so that ‘easy button’ maybe not even be available. I’ll be curious to see how this all plays out.
