Hey everyone,

Just have a quick question on the CF Leave Policy. I was wondering if you have exhausted all of your Annual Leave, are you able to buy any or all of it back?

The reason why i am asking this is b/c i currently have 4yrs remaining before i retire with a 20 yr pension. I am just coming off of Parential Leave and i am unable to take leave w/o pay until i return the equal amount of days back. I have been offered a 20 day work term in Alberta with the potiential of making almost $18000.00 in this time frame. Any help or advice on this would be great.

Yours isn't so much a question of buying leave back as it is repaying the allowance for parental leave. 

I found an answer under CBI 205.461:

(Repayment) Subject to paragraph (13), a member, who does not serve the required period of service under subparagraph (3)(d) at the end of the maternity leave, parental leave or any other leave without pay and allowances, shall repay all or a portion of the MATA, PATA or both, calculated as follows:

[Total amount of MATA and PATA]) × [Number of weeks not served ÷ Required number of weeks to serve under subparagraph (3)(d)]

I guess i should explained it a little better. I guess what i am asking is once your annual leave has been taken are you able to buy back any of those days.....for example...if i had 22 days remaining in annual leave and took the 20 day work term out west can i buy additional leave.

There is no mechanism to buy extra days of leave from the crown.
 
However, that reference only applies to the year in which the leave is to be earned. You can't take next FY's leave this year.
 
Just go AWOL.  $18,000 will more than cover the fine (or forfeited salary if sentenced to the digger) with change to spare.  :evil:
 
Any accrued or accumulated leave still sitting in your pocket??
 
What if you got hurt and had to rehab for a year? Do you expect the military to pick that up? Who does your job while you're off?

You either want a military career or one in the private sector. Take your pick, but you can only do one.

Army 101......Or, would your CO's CO approve LWOP if your service terms were extended? Ans: I have to pay back the equal amt of day before trying that option....once i have done so i will be looking into that option as well.


garb811......great idea but I've spent enough time in trouble when i was in the army for 12 yrs....lol



PAdm.....i have 4 Accum still i would like to keep those for emergency's  if all possible

Ans : Sure do, to a certain point but the company i work with from time to time has amazing coverage and I'm able to use it as well I'm currently covered by both dnd and the company I'm with....while on the books with this company and on annual leave with dnd there are times I'm covered up to 175 % dental and 180 % medical. 3)Who does your job while you're off? Ans: The same ppl who does it when I'm off on annual leave or sick leave or any other days given off.4)You either want a military career or one in the private sector!. Ans: I already have both actually just trying to find a way to increase my civi experience for when i do retire in 3.5 yrs and and money is also a driving factor in this...you can't tell me if someone told you to take annual leave to make up to 18000 in 20 days you wouldn't.....comeon! 5) Take your pick, but you can only do one. Ans: Not to sure but I've been running my own business for the past 6yrs along with the military career as well.....knowledge is power my friend.

Anyway not to beat a dead horse.....greatly appreciate the info and replies. Once i get a solid ans on this i will update in case this situation arises again.

I saw someone try to do something similar.  He had applied for and was given a "conditional offer of employment" with CBSA.  The condition was that he had to attend and pass their training course which was 4-5 months long.  He applied for LWOP and was denied.
