The Federal Court of Appeal has upheld the Federal Court decision that the invocation of the Emergencies Act was unconstitutional.

Yup. The Emergencies Act didn’t play into any of the criminal and provincial statute enforcement powers that were actually relied on on the ground. Everyone arrested and convicted was arrested and convicted on offences that were already on the books and clear in their application.

Good to have the FCA weigh in so that the government can decide if the EA as written and as linked to the CSIS act is up to the task for modern national security challenges.

If it was only a little hissy fit, the GoC wouldn't have felt it had to enact the EA... it would have been handled like any other protest.

I honestly believed that the bright people in Ottawa were convinced the protest convoy would lose momentum by the time it reached the Whiteshell and for sure would be gone by Thunder Bay. This was the previous MO of all the western protests and they had no idea the anger that had built up in the land.
That nobody said “What do we do if these folks actually get to Ottawa?” is still very worrisome to me.
I really hope they have learned a lesson or two.

I’d agree with that. I was saying it myself in the first pages of this very thread, and ended up working front line in the event. While the numbers they were throwing out were still hilariously out to lunch, the few thousand people who DID show up and dig in made one hell of a mess. They had made their core intention and occupying downtown Ottawa very clear, so once it was obvious how many were coming, we should have been more ready and not let them dig in as they did.

As I’ve said before (granted with the benefit of hindsight) it should have been a full court press by police starting before first light the Tuesday morning after that first weekend. Catch ‘em all snoozy and without the weekend crowd.

While the numbers they were throwing out were still hilariously out to lunch, the few thousand people who DID show up and dig in made one hell of a mess. They had made their core intention and occupying downtown Ottawa very clear, so once it was obvious how many were coming, we should have been more ready and not let them dig in as they did.

I’m still amazed why OPS didn’t intracity comandeer OCTranspo’s heavy 30T and 40T wreckers to pull the rigs off Wellington and environs.

Back in the army 90s when I was working for the NCC we picked up a blue rocket to move on Canada Day with a backhoe. Turns out we forgot to clear it and carried a lady from the west block to the east block.
