Ostrich Cull in BC, 2025

Denial of leave to appeal (I.e., ‘will SCC take this matter up?) by the Supreme Court means the Court of Appeals decision stands. That means the final ruling of the court is that CFIA is acting within its legal authorities, and the temporary stay that was in place pending SCC decision on leave to appeal is lifted.

Most matters that request leave to appeal to SCC don’t get heard. If there’s a split decision at the Court of Appeals level then there’s an automatic right to appeal to SCC, but generally if there’s a unianimous Court of Appeals level decision, SCC will only grant permission to appeal to it if there’s some legally justiciable question on a pressing matter of sufficiently broad interest. Otherwise the Courts of Appral are trusted to have made a sound decision. Simply disagreeing with the result at the Court of Appeals level doesn’t entitle a party to an SCC hearing.
 
I heard the poor daughter on CBC this morning was again trying to drum up support to save these poor animals they have been caring for the last 35 years, and the horror that destroying them would be.

Except that until they started dying originally, these birds were processed as meat birds, and their fat was being sold to a beauty company. They were on the verge of bankruptcy, and had outstanding liens against any monies to be paid out by CFIA. I'm a cynical person, and say that all this hoopla was really about getting some additional Go Fund me money to pay off debts and be able to keep the land.
 
The Supreme Court of Canada just denied the farm leave to appeal, meaning the stay is lifted and the cull can proceed. Presumably that’ll happen in very short order.
It’s been a long time since the Supreme Court of Canada has used the following words “ … the stay of execution has been dismissed.”

That being said, those birds should have been put down in March.
And god help us if the bird flu starts hitting the meat chicken supply like it is hitting the egg producers, you could be paying 30$ for a pack of 4 chicken breasts.

I have somewhat tried to be charitable to that farm, but the fact is they have been quite manipulative and social media savvy.

Yup. You just don’t chance it with the integrity of the food supply. HPAI can be utterly devastating.
