Agree. Reprehensible as the comments may be, it seems he violated State law. The comments defending his actions strike me a legally thin soup. If he was acting in his capacity as a police officer, where is his authority or judicial authorization. I doubt the California legal system allows for warrantless fishing trips to capture words that probably aren't a crime in the first place. A statement made in a locker room or open office seem hardly to be in private.

Under our law, it would be legal if he was party to the conversations, but there is no indication that he was.

He isn’t investigating a crime. It’s not criminal to be a piece of shit. There are also internal mechanisms to put in these workplace complaints about conduct.

If went to Walmart and started investigating “low low prices” his status wouldn’t protect him or give him access to anything. It’s the same thing here
