Trade court orders tariff refunds in setback for Trump administration​

A federal judge has cleared the way for thousands of businesses to receive refunds for tariffs that the Supreme Court struck down last month.
The US Court of International Trade on Wednesday ordered Customs and Border Protection to issue refunds for levies US President Donald Trump introduced last year under the International Emergency Economic Powers Act (IEEPA).
"All importers of record whose entries were subject to IEEPA duties are entitled to the benefit" from the high court's ruling, Judge Richard Eaton wrote.
The payment process remains murky. But the trade court decision marks a setback for Trump, who has moved to replace the import taxes and bemoaned the prospect of refunds.

So many law firms in the US are rubbing their hands in delight.
The trade court ordered all tariffs be repaid to everyone who paid them. That does not leave much space for further litigation unless consumers start going after retailers.

What if a government illegally violates the rights of thousands of it's citizens? Is there any path to indemnify those harmed?

The illegal enactment of the EA. Granted this is irrelevant to this thread and I don't expect a tangent. Just curious if some measure exists to hold our government accountable like in the US.

I’ll bite too. What action are you construing as illegal?

you as a voter have 3 actions (that I can see) available: Sue the government, complain to you member of parliament and/ or vote against the party/candidate that you believe has acted illegally.

Various legal actions have already been filed on that, so we’ll see over the next couple years of proceedings in civil court. Generally speaking in civil matters actual harm will have to be demonstrably tied to the impugned conduct. I expect a lot of rhetoric will lump enforcement actions writ large in with the invocation of the EA, but hence in practice the vast majority of tangible action taken had nothing to do with it.

In cases where anyone was materially harmed by the invocation of the EA that was later struck down by the courts, I’m fully supportive of whatever recourse the courts order. I trust my take on this is sufficiently consistent for you?

Sorry - I am confused. What measures exist right now to hold the Trump administration accountable? Note I say the Trump administration vice the USG...because he and Congress have made it clear that he is the government, and is unbound by trivialities like the Constitution.

The exact same measures as in the USA exist in Canada, the courts. If you think that they are doing something illegal, you sue them and let the judges determine the outcome. And of course, there is the other remedy - elections.
