Here is a situation and wanted to know if this appears to you as a conflict of interest.

If an ASurg has a grievance, complaint, possible court litigation and possible complaint to the college of physician against him by an individual and his is still involved with this individual to determine his health care.

Does this not constitute a conflict of interest?

No.
It's not even close.

The doctor would have to be benefiting somehow for there to be a conflict of interest.
This is the exact opposite.

From the College of Physicians and Surgeons of Ontario website.
http://www.cpso.on.ca/policies/conflict.htm

The principle behind these regulations is that the physician's obligation is to the best interests of his or her patient and that this interest must not be in conflict with financial or other interests of the physician. Patients should not have to be concerned when they are referred for a medical service or to purchase a medical device by a doctor about whether the doctor is receiving financial benefit from such a transaction.

even if the doctor knows the content of the grievance and complaint against him. He could certainly benifit of that information when dealing with the patient, no?

How can anyone possibly get a financial or other benefit from knowing the contents of
a grievance against them?
