From what I've managed to piece together:
Current government (Sejm) voted in new judges for the Constitutional Court but President Nawrocki has refused to have an official confirmation, thus the current judges (voted in by PIS) stay on illegally. The problem being the President is technically not obeying the constitution, he doesn't personally confirm anyone but must only be present at the swearing in. It's basically a single line that's causing all of this.
The current PIS judges were not arrested, but suspended.
This is also the reason why that court has been non-functioning since 2023, though some argue it goes back even further to 2015.
