A democratically elected Executive and Congress that think it is okay to have its agents detain US citizens 'under they sort things out', feel that habeas corpus is optional, and that terms such as 'war' and 'insurrection' are, like your taglines, mean just what they choose them to mean, extra-judicial and international killings included. I'm not aware that any new laws have been enacted to enable much of this Administrations policy.
Maybe legislators in most democracies felt that, sometimes, politicians can't be trusted. The UK has traditionally taken the view that Parliament is sovereign, but their Supreme Court (which has only existed since 2009) has made a few decisions that suggest that it may have a different view.
