That bit in yellow, though, would affect any internal CAF proceedings linked to any conviction, I suspect, no?
NDA 92, maybe? Scandalous Conduct by Officers? Might be a stretch, but I don't recall seeing this in CM of late. The last published trial of NDA 92 I could find was in 2008.

DMP might gun shy (ha) at prosecuting him under the NDA after pleading guilty to the CBSA stuff because of the risk to double jeopardy. The optics of doing it after a guilty plea might be bad too.

I wasn't going down that road, just pointing out a potential service offence. I'm sure there will be an AR following this, if it hasn't been done already.

IMHO, I can't see any reason why anyone would want to take the time and effort to pursue a CSD case against him even if not barred by double jeopardy. The crown has covered all of that. Administrative action taken on the facts disclosed and the criminal conviction is enough and appropriate.

True enough but my main focus is that the military system is seen as addressing an issue and not just ignoring it.

I don't even want to bother contemplating what the right action is for this offence, but someone in the system needs to address it and then come out with a proper and timely decision that isn't merely punishment being piled on.

I agree. CAF members need and deserve to see a system that is effective.

:giggle: As we speak I'm trying to take fifty pages of stuff I've written and notes that I've made (linked to several hundreds of pages of reference material) and try to reduce them to a coherent twelve-page epilogue for our three "With A Few Guns" books. The last thing I need or want is "light reading" in the form of a DAOD.

I keep popping in and out of this forum as a way of keeping my sanity.
